XpeedMile Solutions Ltd. - Terms and Conditions
1. Definitions

"XpeedMile" refers to XpeedMile Solutions Ltd., a company incorporated under the laws of Ontario, Canada.

"Customer" refers to any individual or entity that uses XpeedMile's services.

"Shipment" refers to any item(s) transported by XpeedMile.

2. Services
XpeedMile provides a variety of courier and delivery services, including but not limited to:

Same-day delivery
-
Next-day delivery
-
Priority delivery
-
Scheduled delivery
-
Specialized transport for valuable or sensitive items

3. Booking and Payment

Customers can book deliveries online, via phone, or in person.

Payment is due upon booking unless otherwise agreed upon in writing by an authorized representative of XpeedMile.

XpeedMile accepts various payment methods, including credit cards, debit cards, and cash.

4. Customer Responsibilities

Accurate Information: Customers are responsible for providing accurate and complete delivery information, including:

Sender and recipient details

Complete addresses with postal codes
-
Valid contact information (phone number and/or email address)

Packaging and Labeling: Customers ensure their shipments are properly packaged and labeled, comply with all applicable regulations, and provide safe transport.

Customs and Taxes: Customers are responsible for any applicable customs duties, taxes, or other fees imposed on their shipments.

5. XpeedMile Responsibilities

Timely Delivery: XpeedMile will make every reasonable effort to deliver shipments on time, by the chosen service and estimated delivery timeframe. However, delivery timeframes are not guaranteed and may be affected by factors outside XpeedMile's control.

Careful Handling: XpeedMile will handle all shipments professionally, emailing or SMSing customers with updates on the status of their deliveries and taking precautions to prevent damage or loss.

Delivery Updates: XpeedMile will provide customers with updates on the status of their deliveries via email or SMS, as requested.

6. Liability

Limitations: XpeedMile's liability for lost or damaged shipments is limited to the lesser of:

The declared value of the shipment.

A maximum of $100, unless additional insurance has been purchased.

Indirect Damages: XpeedMile is not liable for any indirect, consequential, or incidental damages arising from the use of its services.

Events Outside of Control: XpeedMile is not liable for any delays or damages caused by events outside of its control, including but not limited to:

Weather conditions (e.g., snowstorms, floods)
-
Traffic delays or accidents
-
Natural disasters (e.g., earthquakes, fires)
-
Pandemics or public health emergencies
-
Civil unrest or acts of terrorism
-
Major transportation disruptions (e.g., airline or railway strikes)

7. Insurance

Additional Coverage: Customers can purchase additional insurance for their shipments at an extra cost, covering a higher declared value.

Claims Process: Insurance claims must be filed within 30 days of the delivery date, accompanied by relevant documentation (e.g., proof of purchase, photos of damage). To initiate a claim, customers should contact XpeedMile's customer support department with the shipment details and the nature of the claim.

8. Prohibited Items
XpeedMile does not transport the following items:

Illegal substances or contraband

Firearms, weapons, or ammunition

Explosives, flammable materials, or hazardous substances
-
Perishable goods (unless specialized transport is arranged)

Live animals

9. Cancellation Policy

Customer Cancellation: Customers may cancel a scheduled delivery with at least 24 hours' notice. Cancellations made within 24 hours of the scheduled pickup time may be subject to a cancellation fee.

XpeedMile Cancellation: XpeedMile reserves the right to cancel a delivery at any time due to unforeseen circumstances or events outside its control. In such cases, customers will be notified promptly and offered a full refund or the option to reschedule the delivery.

10. Privacy Policy
XpeedMile is committed to protecting its customers' privacy. Please refer to our separate Privacy Policy [insert link to privacy policy] for detailed information on how we collect, use, and protect your personal information.

11. Dispute Resolution
Any dispute arising from or relating to these terms and conditions will be settled through amicable negotiations between the parties. If the parties cannot resolve the concerns through negotiation, the dispute shall be submitted to binding arbitration by the laws of the Province of Ontario.

12. Severability
Suppose any provision of these terms and conditions is held invalid or unenforceable. In that case, such provision shall be struck, 3 XpeedMile and the customer regarding the remaining provisions2 shall remain in full force and effect.

13. Entire Agreement
These terms and conditions constitute the entire agreement between XpeedMile and the customer regarding the subject matter herein and supersede all prior or contemporaneous communications and proposals, whether electronic, oral, or written.

14. Amendments
XpeedMile reserves the right to amend these terms and conditions without prior notice. The latest version of the terms and conditions will be posted on XpeedMile's website.

15. Governing Law
These terms and conditions are governed by and construed by the laws of the Province of Ontario and the federal laws of Canada applicable therein.8
